                     TERMS AND CONDITIONS FOR NEWS PORTAL

 

INTRODUCTION OF CLAUSES

 

Our Terms and Conditions were last updated on 31st March 2023.

 

These are the conditions that apply to the contract between the user and the company. The rights and responsibilities of all companies with respect to the contract are outlined in these Terms and Conditions. Please read these terms and conditions carefully before entering the agreement.

 

1. DEFINITION CLAUSE 

 

For the purposes of these Terms and Conditions: -

 

1.1 Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.

 

1.2 Country refers to: Karnataka, India.

 

1.3 Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to the News Portal.

Device means any device that can access the Service such as a computer, a cell phone or a digital tablet.

 

1.4 Service refers to the Website.

 

1.5 Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between user and the Company regarding the use of the Service. 

 

1.6 Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.

 

1.7 Website refers to News Portal, accessible from.

 

1.8 User means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

 

2. GOVERNING AND APPLICABLE LAWS:

 

Any disputes relating to this agreement shall be governed by the laws of India, and the company and the user hereby submit to the exclusive jurisdiction and venue of the courts located in Mangalore (Karnataka). Any other venue to which any party may be entitled by virtue of domicile or otherwise is waived by both parties.

 

3. OBLIGATIONS OF CLAUSES:

      

3.1 Service Eligibility: 

 

To access or use these services of the Company, users must be at least 16 years of age or, if older, the age of majority in user jurisdiction, otherwise users may not use these services. An employer and its authorised agent(s) are permitted to use the employer's free employer account and any data about that employer provided via that account for the employer's internal business purposes. Except as set forth above, user, or as otherwise approved by us, user, is for user personal, non-commercial use unless the user enters into a separate agreement with us for user commercial use. A user may not use the Company's website if we have terminated the user account or banned the user.

 

4. USE OF PROHIBITED ACTIVITIES

 

4.1 You may use the Website only for lawful purposes and in accordance with these Terms of Use. You agree not to use the Website:-

 

4.1.1 In any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the INDIA or other countries).

4.2 Additionally, you agree not to: -


4.2.1 Use the Website in any manner that could disable, overburden, damage, or impair the site or interfere with any other party’s use of the Website, including their ability to engage in real time activities through the Website. 

 

4.2.2 Use any robot, spider, or other automatic device, process, or means to access the Website for any purpose, including monitoring or copying any of the material on the Website.

 

4.2.3 Use any manual process to monitor or copy any of the material on the Website, or for any other purpose not expressly authorised in these Terms of Use, without our prior written consent. 

 

4.2.4 Use any device, software, or routine that interferes with the proper working of the Website. 


4.2.5 Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.


4.2.6 Attempt to gain unauthorised access to, interfere with, damage, or disrupt any parts of the Website, the server on which the Website is stored, or any server, computer, or database connected to the Website. 


4.2.7 Otherwise attempt to interfere with the proper working of the Website.


5. INDEMNIFICATION CLAUSES

 

5.1 User consents to defend, indemnify, and hold Company, its subsidiaries, affiliates, licensors, employees and agents, harmless from any claims, damages, costs, liabilities, and expenses (including, but not limited to, reasonable attorneys' fees) resulting from user conduct.

 

5.2 In the case of defamatory conduct by the user, the user shall pay the damages.

 

6. THIRD PARTY

 

The site may from time to time contain links to and from other websites. users agree that the Company is not liable or responsible for any loss or damage caused as a result of the users of any third-party services linked from the website. 

 

7. MINOR AND ADDITIONAL CLAUSES

 

Users must be at least 16 (sixteen) years of age to use this Website, or any Services contained herein. By using this Website, the user represents that they are at least 16 years of age and may legally agree to these Terms of Service. The owner assumes no responsibility or liability for any misrepresentation of the user's age.

9.2 Company uses reasonable efforts to ensure the accuracy, correctness and reliability of the content, but we make no representations or warranties for the same. Images of people or places displayed on the Site are either the property of, or used with permission by, company or third parties.

 

9.3 Company will not be liable for any damages of any kind arising from the use of this site. The functions embodied on or in the materials of this site are not warranted to be uninterrupted or without error.

 13. LIMITATION OF LIABILITY

 

Except where prohibited by law, the company and its respective directors, officers, employees, agents, service providers, contractors, Licensors, Licensees will not be liable for negligence, gross negligence, negligent misrepresentation, fundamental breach, or damages of any kind, under any legal theory, including any direct, indirect special, incidental consequential, or punitive damages, including, but not limited to, personal injury.

 

14. TERMINATION

 

You are free to stop using our service at any time. We reserve the right to suspend or terminate your access to the service with notice to you if:- 

 

●      you are in breach of terms.

●      your use of services would cause a real risk of harm or loss to us or other users, or 

 

We will provide you with reasonable prior notice via the email address associated with your account in order to correct the behaviour that caused us to contact you and give you the opportunity to export your items from our services. If you do not cooperate with our requests after getting such notification, your access to the service may be terminated or suspended.

 

We will not provide notice or a chance to export your data prior to the service's termination or suspension; -

 

●      By doing so, we would expose ourselves to liability or jeopardise our ability to offer our other customers the service.

15. SEVERABILITY

 

If any provision of the agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

 

16. FORCE MAJEURE

 

If the force majeure affects the performance of the contract, the party that is subject to force majeure shall promptly notify the other party and submit to the other party a sufficient and valid proof of force majeure within a reasonable period after the end of force majeure. Otherwise, the corresponding liability shall not be waived.
 

17. WAIVER CLAUSE

 

Except as provided herein, the failure to exercise a right or to require the performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

 

18. MODIFICATION 

 

M/s Bisjhintus Private Limited reserves the right to modify the terms of this agreement at any moment. M/S Bisjhintus Private Limited is unrestricted in offering its services to any customer or potential client.

 

19. SERVICES

 

We always commit to giving our users the best service but in the case of any damages done by any unaffiliated party, M/S BISJHINTUS PRIVATE LIMITED will not be liable for this.

 

20. COMPANY RIGHTS

 

20.1 We have the right, without provision of notice to:

 

A)   Take appropriate legal action, including, without limitation, referral to or cooperation with law enforcement or regulatory authorities, or notifying the harmed party of any illegal or unauthorised use of the website. 

 

B)   Terminate or suspend your access to all or part of the website for any or reason, including, without limitation, any violation of this agreement. 

 

Provided that, You are solely and entirely responsible for your use of the website and your computer, internet, and data security. 

 

20.2 You agree to release and hold harmless the company and its parent, subsidiaries, Affiliates, and their respective directors, officers, employees, agents, service providers, contractors, Licensors, licensees, and successors from any and all claims resulting from any action taken by the company and any of the foregoing parties relating to any, investigations by either the company or law enforcement authorities.

 

21. GUIDELINES FOR USER

 

21.1 The user is not allowed to save or obtain any data from a computer system with the intent of infringing on the intellectual property rights of others.

 

21.2 The User is solely responsible for maintaining the confidentiality of the User password and user identification, as well as all activities and transmissions carried out by the User using his user identification. M/S BISJHINTUS PRIVATE LIMITED accepts no blame or liability for any inaccuracy. 

 

21.3 M/S BISJHINTUS PRIVATE LIMITED shall not be liable for any loss or damage resulting from any disclosure (inadvertent or otherwise) of information relating to or regarding online transactions involving credit cards or debit cards, and/or their verification process and particulars, as well as any error, omission, or inaccuracy with respect to any information so disclosed and used, whether or not in accordance with a legal requirement.

 

22. GENERAL PROVISION

 

Despite not routinely doing so, M/S BISJHINTU'S PRIVATE LIMITED retains the right to look over user website postings. However, We will take whatever action it considers appropriate in its sole discretion if it learns of the improper use of our website or any of its Services. Users agree that the company will have the right to report any actions that could be regarded as illegal, as well as any information it obtains about such illegal behaviour, to law enforcement officials. Company will completely cooperate with law enforcement authorities upon request in any investigation into alleged illegal Internet behavior.

 

23. PAYMENT CLAUSES

 

23.1 The payment mode accepted by the Company is either through net banking or any other online mode which is acceptable by the company.

 

23.2 You agree to pay all fees and charges accrued as a result of using the news portal in accordance with the billing terms and fees in effect at the time the fee or charge is due and payable. You also pledge to pay all applicable taxes, no matter where they may be. You must provide valid payment details along with your purchase.

 

23.3 We process refunds according to our refund policy.

 

24. REFUND POLICY

 

24.1 If the user sends in a request of refund after 2 (two) days of availment of the subscription, there shall be no refund given in such cases. 

 

24.2 In cases of a user buying two subscriptions together, in such instances the refund shall be reflected back within 7 days of such date.

 

25. AMENDMENTS 

 

Any amendment to this agreement shall be done in writing and such amendment shall be signed by both parties.

 

26. ACCEPTANCE CLAUSE 

 

26.1 These are the Terms and Conditions governing the agreement that operates between the user and the Company. These Terms and Conditions set out the rights and obligations of all companies regarding the agreement.

 

26.2 Notwithstanding this clause, After entering the agreement, we will assume that users have read all our policies which users are supposed to read.

27. REFERRAL POLICY 

 

Our referral policy provides users with the details of how we will entertain referral , mode of sharing the referral link, referral rewards, time limit and terms of validity etc. user should read our referral policy before entering the agreement.  

 

28. PRIVACY POLICY

 

The business and the other contract party are the only parties to the information in the agreement. The information gathered is only used to fulfil the agreement and maintain the account for sale. Before entering the agreement, please thoroughly read Our Privacy Policy.
