In the realm of creative expression, the rise of machines as creators is redefining the landscape. Since the 1970s, computers have dabbled in producing art, a trend now propelled by rapid developments in machine learning, a subset of artificial intelligence. This new wave introduces a transformative relationship between computers and creativity, raising intricate legal and commercial considerations.

 

Machine learning software, driven by algorithms, learns from data input to produce independent works. This autonomous process poses a challenge for copyright, as creations emerge without direct human authorship. Works produced in music, journalism, and gaming via artificial intelligence could potentially lack copyright protection, jeopardizing investments made by companies in these ventures.

 

The impact on the creative economy remains uncertain. If doubts persist about copyright eligibility for AI-generated content, investments in automated systems might decline. Despite potential savings from using AI for time-consuming tasks, the blurred line between human and machine creativity adds complexity.

 

As computational power advances, distinguishing between human-generated and machine-generated content becomes challenging. The idea of granting copyright to those who enable AI operation emerges as a solution. The UK's model, where copyright goes to the enabler, is a viable approach to foster technological investment.
