A new law governing the use of Artificial Intelligence (AI) technologies is under consideration, with the European Union (EU) reaching a broad political agreement on the matter. Although the final text is yet to be revealed and requires approval from Europe's parliament, the focus is on establishing guidelines that prevent AI abuse while fostering innovation. The EU's initiative aligns with global efforts to regulate AI, particularly in response to the proliferation of generative AI products. The United States government also issued an executive order on October 30, outlining principles for the "safe, secure, and trustworthy development and use of AI."


The emergence of AI products like the ChatGPT chatbot and image creation tools such as Dall-E and Midjourney highlights the vast potential of AI in enhancing productivity, fostering invention, and enabling discovery. However, it also raises concerns about truth discernment, as AI-generated content blurs the lines between reality and synthesis. The EU's regulatory efforts aim to strike a balance that safeguards against AI misuse while fostering technological advancement, crucial in a competitive landscape where European tech companies vie with counterparts from regions with less stringent AI regulations.


While specific details of the EU law remain undisclosed, there is apprehension about its coverage of certain risky applications, such as emotion recognition and unrestricted predictive policing. However, it reportedly prohibits systems capable of categorizing biometrics, recognizing the potential for deep, population-level profiling implications. In a parallel move, the Biden administration's executive order in the US extends the scope of regulations, incorporating safety testing requirements, equity and civil rights principles, and addressing economic and privacy concerns.


As AI regulation gains momentum globally, the proposed EU law and the US executive order serve as valuable starting points for initiating conversations on AI regulation in India. This collective effort seeks to harness the benefits of AI while mitigating potential risks and ensuring ethical and responsible use in various domains.
